Who works with your data?

The controller of your data is Mgr. Lukáš Pelcman, with registered office at Ostrovní 126/30, 110 00 Prague 1, Czech Republic (the Controller, or I). You can contact me at the registered office address or by email here.

Why do I work with your data, what data is involved and what entitles me to do so?

1. Provision of legal services. I have to work with your data when arranging and providing legal services. This concerns in particular activities under the regulations governing the practice of law — for example defending and exercising your rights, or communicating with you by email or telephone.
2. Compliance with legal obligations. I process your data in the performance of the Controller's legal obligations under tax and accounting law and under the act on measures against the legalisation of the proceeds of crime. An attorney is an obliged person under Act No. 253/2008 Coll., on Certain Measures against the Legalisation of the Proceeds of Crime and the Financing of Terrorism, as amended, and is obliged under that act to carry out the measures it lays down, including identification and screening of the client. For that purpose the attorney must collect and retain the client's personal data and take copies of the documents used to verify it.
3. Protection of my legitimate interests. I may use your data, and data about your use of my services, to protect my rights — for example when recovering outstanding debts.
4. Sending news. From time to time I may contact you with news about my services or with relevant legal and business information. Such use is a legitimate interest of mine.

How long will I work with your data?

I will process your data for as long as the services are provided, and thereafter for the period laid down by law, namely:

1. For the duration of the services and for 10 years after our contractual relationship ends.
2. For the period laid down by the relevant legislation.
3. For the duration of the services and for 10 years after our contractual relationship ends, or longer where a justified need to retain the data arises in connection with a particular matter.
4. Until you object.

Who may I pass your data to?

I may pass your data to my employees and to other processors on the basis of a contract with them, but always only to the extent necessary to fulfil the purposes of the processing and to provide my services. If I transfer data outside the EU, it will be protected under standard contractual clauses.

Your rights

Data protection legislation guarantees you a number of rights. To the extent that data protection rules — in particular the GDPR — guarantee you this, you may ask me for access to your personal data (that is, information about which of your data I work with and how), for restriction of the processing (meaning that I will not erase the data yet, but will not work with it either), and for its rectification and erasure (always where the statutory conditions are met). You may also object to the processing and exercise your right to data portability. To exercise any of these rights, contact me using the details above — the simplest way is to send an email and I will gladly help you. If you believe that I am breaking the law in processing your personal data, you may lodge a complaint with the Czech Data Protection Authority.

Objections to processing

If you do not want me to use your data to send you news, you can refuse. The simplest way is the link contained in every such email; you can also send me an objection by email or by letter, and, where technically possible, at the point of registration. If you refuse such processing, I will stop sending you those newsletters. You may also refuse other processing based on legitimate interest, which I will then restrict unless I can demonstrate compelling and qualified legitimate grounds for it.

Cookies

In accordance with the law, this website stores files on your device, generally known as cookies — small text files that the website you visit sends to your browser. They allow the site to record information about your visit, such as your preferred language and other settings, which can make your next visit easier and more productive. I may also use third-party cookies.

Under Act No. 634/1992 Coll., on Consumer Protection, as amended, a consumer has the right to out-of-court resolution of a consumer dispute arising from a contract for the provision of legal services. The body authorised to resolve such disputes between an attorney and a consumer out of court is the Czech Bar Association (more information here).
